1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of FossickHQ, a collections management platform operated by FossickHQ Pty Ltd ("FossickHQ", "we", "us", or "our"), located at 18 The Strand, Kennington VIC 3550, Australia.

By accessing or using FossickHQ, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

2. Account Registration

To access the platform, you must be invited by an account Administrator or create an account through our sign-up process. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access to your account

You must be 18 years of age or older to create an account. Accounts may not be shared between individuals.

3. Permitted Use

FossickHQ is provided for the purpose of managing heritage, museum and archival collections. You agree to use the platform only for lawful purposes and in accordance with these Terms.

You must not:

• Upload content that infringes any third-party intellectual property rights
• Upload material that is unlawful, defamatory, or culturally inappropriate without proper authorisation
• Attempt to gain unauthorised access to any part of the platform or its underlying systems
• Use the platform to transmit malware, spam, or harmful code
• Reverse engineer, decompile, or disassemble the platform software
• Resell or sublicense access to the platform without our written consent

4. Subscription Plans and Payment

FossickHQ offers a free Starter plan and paid subscription plans. Plan details, pricing, and included features are published at fossickhq.com/pricing.

• Subscriptions are billed in advance on a monthly or annual basis
• All prices are in Australian Dollars (AUD) and include GST where applicable
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change pricing with 30 days notice to active subscribers
• Refunds are provided at our discretion for annual plans cancelled within 30 days of payment

5. Your Data and Content

You retain full ownership of all content you upload to FossickHQ, including catalogue records, images, documents and metadata ("Your Content").

By uploading content, you grant FossickHQ a limited, non-exclusive licence to store, process and display Your Content solely for the purpose of providing the platform services to you.

We will never sell, share, or use Your Content to train machine learning models without your explicit written consent. You can export your complete data at any time in standard formats.

6. Privacy and Data Security

Your data is stored on servers located in Australia. We apply industry-standard security measures including encryption at rest and in transit, daily automated backups, and access controls.

We collect and handle personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please refer to our Privacy Policy for full details.

7. Intellectual Property

All software, design, trademarks, and branding associated with FossickHQ remain the exclusive property of FossickHQ Pty Ltd. Nothing in these Terms grants you any rights in our intellectual property except the limited right to use the platform as described herein.

8. Availability and Uptime

We aim to provide a highly available service but do not guarantee uninterrupted access. Planned maintenance will be communicated with reasonable notice. We are not liable for losses arising from temporary unavailability.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your access to the platform will cease, but you will retain the right to request a data export for a period of 30 days following termination.

10. Limitation of Liability

To the maximum extent permitted by Australian law, FossickHQ's liability to you for any cause whatsoever is limited to the amount paid by you in subscription fees in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental losses.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active users by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
